What is hemp-derived CBD?

Hemp is a specific part of the Cannabis Sativa L. plant grown worldwide for thousands of years. The versatile, fibrous plant is used to make a wide range of products, including textiles, fabric, paper, rope, insulation, oil, ink, solvent, animal feed, and personal care products.

Due to the 2018 Farm Bill, the term “industrial hemp” is now widely associated with CBD, or cannabidiol, an active ingredient derived from hemp plants. Hemp is often confused with “marijuana,” a non-technical term for parts of the cannabis plant rich in THC.

Cannabinoid chemical compounds serve as the therapeutic and psychogenic principles of cannabis, the only plant known to produce such substances. The cannabis plant contains more than 100 cannabinoid molecules, the most abundant and important being CBD and THC.

The “0.3% Rule”

The 0.3% Rule” – the latest bifurcation of Cannabis Sativa L. – now constitutes federal law, courtesy of the Agriculture Improvement Act of 2018, aka the 2018 Farm Bill. The distinctions made by the bill include:

  • 0.3% max Delta-9 THC content by dry weight – the cannabis threshold to U.S. legality, state and federal.
  • Legal distinction: Delta-9 THC cannabis above the 0.3% line, CBD/industrial hemp below it. Measurements are made by state inspectors doing chemical analysis of crop samples.
  • Cannabis Sativa L., a plant of the genus Cannabis that originated millennia ago growing wild on the steppes of Asia, has (in maturity) five main parts: the root, the stalk (which can bear several stems), the leaves, the seeds and the flowers (buds or nugs).
  • The term ‘kief’ refers to the cannabis plant’s resin glands, the bulbous tip of each trichome and trichome crystalline powder.
  • THC, CBD and other cannabinoids, primarily resident in the flower and leaves, are actually present throughout the entire cannabis plant, even in very slight trace amounts in the seeds, roots and stalks/stems – the supposed “industrial hemp” parts of the plant.

This fact – the measurable presence of THC throughout the entire cannabis plant – makes the term “marijuana” meaningless.

Why is THC content important in CBD?

THC is the psychoactive, mind-altering component that creates the “high” traditionally associated with marijuana. Hemp is defined as having a THC content of 0.3% or less, an amount that will not cause a psychoactive “high” effect when consumed.

In 2018, Congress signed the Agriculture Improvement Act (aka, the 2018 Farm Bill) into law, removing hemp as a federally controlled substance. CBD products derived from hemp are legal in all 50 states, provided they contain less than 0.3% THC.

What are the effects of CBD?

Smoking CBD is one of the most efficient ways to deliver its compounds into your body. When you smoke cannabis cigars, for example, you will almost immediately begin to experience an overall sense of light relaxation and mellow mind-body experience without the intoxicating effects of marijuana.

While the U.S. Food and Drug Administration (FDA) is still learning about how CBD affects the body, the World Health Organization (WHO) research shows no evidence of problems associated with the use of pure CBD.

People who are pregnant or breastfeeding are encouraged to avoid using CBD. CBD should be kept out of the reach of children.
